Copyright Permissions

Non-program copyrighted materials may be copied for noncommerical personal use only, if our copyright notice and website address are included. This permission does not extended to our programs or databases. We reserve the right to revoke any permitted use at any time at our discretion.

Custom Designs

Customization includes any new design or modification to an existing design created by Artist to Buyer's specifications. Artist retains all copyrights and reserves all rights on all customized products and packaging, even when Buyer pays a customization charge. Any customization charge is merely a special order handling fee and does not procure for Buyer any copyright ownership or rights. A customization is NOT a work-for-hire.

Derivative Designs

A derivative design ("Work") is a custom design created by Artist based on a rendering or interpretation of an original design supplied by Buyer ("Original"). Buyer's request for Artist to render a Work from an Original signifies Buyer:
  1. Has the right to authorize the Work based on the Original;
  2. Authorizes the Work;
  3. Acknowledges that Artist will own the copyright and retain all rights to the Work; and
  4. Indemnifies Artist and Seller for all costs which may result from any claim against Artist or Seller for use of the Original to create the Work.
This does not affect or diminish the ownership or rights of whoever currently owns and has rights to the Original. However, it does protect and preserve Artist's ownership and rights to the requested Work.

For example, suppose Buyer orders a lapel pin with a custom Work based on Buyer's Original which is a club logo. Further suppose Buyer wants to make some mugs with the club logo for their members.

Buyer:

  • Has the right to use the Original on the mug (assuming Buyer had that right prior to authorizing the Work).
  • DOES NOT have the right to use the Work on the mug, or anywhere else, without Artist's approval.
Artist:
  • Has the unlimited right to use the Work for any purpose, including selling reproductions of it.
  • DOES NOT have the right to use the Original for any other purpose than to create the authorized Work.
If we did not have this restriction, someone else could legally buy any custom pin and use that design to manufacture pins, greeting cards, mugs, etc.

Limited use licenses are available for sale on some designs. Limited use permissions may be granted in certain limited circumstances. Please contact us for more information on licensing and permissions.

By completing a purchase, Buyer signifies understanding and acceptance of all the above terms.
